Privacy policy

Best Marketing Jupiter is a web design, photography and video studio based in Jupiter, Florida. It is operated by Hawkins Holdings LLC and run by Miller Hawkins (“Best Marketing Jupiter,” “we,” “us” or “our”). This policy explains what information we collect through bestmarketingjupiter.com (the “Site”), how we use it, and the choices you have.

Information you give us

When you use a form on the Site, we receive what you enter:

• Check availability: the services you’re interested in, a preferred date (or that your dates are flexible), a location, your name, business name, email address and phone number.
• Send a message and the contact form: the services you’re interested in, your name, business name, email address, phone number and your message.

Business name, phone number and location are optional. Please don’t include sensitive information such as financial account numbers, passwords, government ID numbers or health information in a form.

Information collected automatically

• Analytics. The Site uses Google Analytics to understand how visitors use it: pages viewed, time on page, the site that referred you, your device and browser type, and your approximate location (city or region) derived from your IP address. Google Analytics uses cookies and similar identifiers to do this. See Cookies and your choices.
• Hosting logs. The Site is hosted by Netlify, which automatically records basic technical information such as IP address, browser type and the pages requested, for security and to keep the Site running.
• Fonts. The Site’s typefaces are served by Google Fonts. To display them, your browser requests the font files from Google, which receives your IP address and browser information.
• Videos. Videos on the Site are hosted on YouTube and shown in its privacy-enhanced mode. Nothing is loaded from YouTube until you press play. Once you do, YouTube (Google) may set cookies and collect information under Google’s privacy policy.
• Site preferences. The Site saves a few small settings in your browser’s local and session storage, such as your cookie choice and whether you’ve already seen the opening animation. These are used only to make the Site work and are never used to track you.

Cookies and your choices

Google Analytics sets cookies (such as _ga) in your browser. A banner lets you accept or decline them, and you can change your choice at any time with the Cookie settings link at the bottom of every page.

• In the European Economic Area, the United Kingdom and Switzerland, Google Analytics is not loaded until you click Accept.
• Everywhere else, Google Analytics runs unless you click Decline.
• If you click Decline, Google Analytics stops right away and is not loaded again.
• If your browser sends a Global Privacy Control signal, the Site does not load Google Analytics at all, and you won’t see the banner.

When you click Decline, the Site stops sending anything to Google Analytics, deletes its analytics cookies, and doesn’t load Google Analytics on later visits. You can also block or delete cookies in your browser settings, or install Google’s Google Analytics opt-out browser add-on. The Site works the same whether or not you allow analytics. We do not use advertising cookies, and we do not use analytics data for advertising.

How we use information

• To reply to your request or message, check availability, prepare a proposal, and plan and deliver a project.
• To understand which parts of the Site people use, and to improve it.
• To keep the Site secure and to prevent spam and abuse.
• To comply with the law and to protect our rights and the rights of others.

How information is shared

We do not sell your personal information, and we do not share it for targeted advertising. We share it only:

• With service providers that help run the Site and our business, such as Netlify (hosting and form handling), Google (analytics, fonts and video) and our email provider, which may process it only to provide their services;
• When required by law, subpoena or other legal process, or when we believe in good faith that disclosure is needed to protect our rights, your safety or the safety of others;
• As part of a sale, merger or transfer of the business, in which case this policy would continue to apply to your information.

How long we keep it

We keep form submissions for as long as needed to respond to you and, if we work together, for as long as needed for that project and for our business, tax and legal records. Analytics data is kept according to the retention settings in Google Analytics.

Security

The Site is served over an encrypted (HTTPS) connection, and we use reasonable measures to protect the information we receive. No method of transmitting or storing data is completely secure, so we can’t guarantee absolute security.

Your rights

You can ask us to tell you what personal information we hold about you, to correct it, or to delete it. Depending on where you live (for example California, Colorado, Connecticut, Virginia, Texas and other U.S. states with privacy laws, or the European Union and the United Kingdom), you may have additional rights under local law, such as the right to opt out of certain processing or to appeal a decision about your request. We will not treat you differently for exercising your rights. Where EU or UK law applies, we rely on your consent for analytics and on our legitimate interest in responding to inquiries and running the Site, and you may complain to your local data protection authority. To make a request, use the contact form. We may need to verify your identity before acting on it.

Children

The Site is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has sent us personal information, contact us and we will delete it.

Other sites

The Site links to other websites, including sites we have built for clients, YouTube and millerhawkins.com. Those sites are run by others, their own privacy policies apply, and we are not responsible for their content or practices.

Changes

We may update this policy from time to time. The version posted here, with the date above, is the one in effect.

Terms of use

By using the Site you agree to these terms. If you don’t agree, please don’t use the Site.

Requests, quotes and bookings

Checking availability, sending a message or receiving a reply does not create a contract, reserve a date or guarantee availability. A project or shoot is booked only when we both sign a written agreement and any required deposit is received. That agreement, not these terms or anything on the Site, governs the work, pricing, deliverables, ownership, usage rights, revisions and cancellation.

No guaranteed results

Descriptions of our services on the Site are general and may change. We do not guarantee any particular outcome, including search engine rankings, visibility in AI tools, website speed scores, traffic, leads, bookings or sales. Words like “fast,” “built to be found” and “set up for search” describe how we approach the work, not a promise of results. Testimonials reflect the individual experiences of specific clients; your results may differ.

Client work shown on the Site

Websites, photographs and videos shown on the Site are examples of work we created for clients or on assignment. Client websites we link to are owned and run by those clients, who are responsible for their content, products, services and any changes made after delivery.

Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, sending spam or malicious code through a form, impersonating anyone, or using automated tools to scrape or copy it.

No warranties

The Site and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the Site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Hawkins Holdings LLC, doing business as Best Marketing Jupiter, and its owners, members, employees and contractors, including Miller Hawkins, will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars ($100). This section does not limit any liability that cannot be limited under applicable law, and it does not apply to a signed client agreement, which governs on its own terms.

Indemnity

You agree to indemnify and hold harmless Hawkins Holdings LLC, doing business as Best Marketing Jupiter, and its owners, members, employees and contractors, including Miller Hawkins, from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these terms, or your violation of anyone else’s rights, including copying or using our work without permission.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or related to the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

General

If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce any part is not a waiver. We may update these terms at any time; continued use of the Site means you accept the current version.

Copyright & image use

The photographs, videos, designs and text on the Site are © Miller Hawkins and Hawkins Holdings LLC, or their respective owners, and are protected by U.S. and international copyright law. Some photographs were made on assignment for news and media organizations, which may hold rights in them; they appear here as examples of Miller’s work. Viewing the Site does not give you any license or right to use any of it.

What you may not do

Without our prior written permission, you may not:

• Download, copy, screenshot, reproduce, publish, distribute or display any photograph, video or design from the Site, including on social media, websites, in print or in advertising;
• Edit, crop, filter or alter any image, or remove or change any copyright notice, watermark or metadata;
• Hotlink to, frame or embed images from the Site;
• Use any image, video or other content from the Site to train, fine-tune or test artificial intelligence or machine-learning systems, or include it in any dataset;
• Use any image to suggest that we, or anyone shown, endorse a product, service, cause or person.

Sharing a link to the Site is fine. To license a photograph, send a request through the contact form. Unauthorized use may result in a demand for licensing fees and legal action, including claims for statutory damages where available.

People in these photographs

The public figures shown on the Site appear as examples of Miller’s editorial, news and event photography. Their appearance does not mean they endorse, sponsor or are affiliated with Best Marketing Jupiter or its services, and none of these images may be used to imply that. Private clients appear with their permission. If you appear in an image and would like it removed, contact us and we will review your request promptly.

Logos, trademarks and brands

Names and logos of clients, publications, networks and other organizations shown on the Site are the trademarks of their respective owners. Publication and network logos identify outlets where Miller’s photography has appeared; they are credits for photojournalism and editorial work, not website clients. Client logos identify businesses we have worked with. None of them implies that those organizations endorse or are affiliated with Best Marketing Jupiter beyond that work. Videos produced for a consumer brand are shown as portfolio examples, and that brand owns its own trademarks and content.

Report misuse

If you see our work used somewhere without credit or permission, or believe something on the Site infringes your rights, please tell us through the contact form and include enough detail for us to find it. We review every request.

Accessibility

We want everyone to be able to use the Site, including people who use screen readers, keyboard navigation, magnification or other assistive technology. We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1, level AA. The Site includes text descriptions for images, works with a keyboard, and respects your device’s reduced-motion setting by replacing the opening animation with a simple fade.

Accessibility is ongoing work, and some content may not yet be fully accessible. If anything on the Site is hard to use, please let us know through the contact form. Tell us the page and the problem, and we will provide the information in another way and work to fix it.
